UK Public/Administrative Law advice needed Re: Complaint against NHS Trust?

I was referred to a hospital specialist in Jan 07. He began to harass me at home %26amp; via my mobile phone [I have kept the messages]. I submitted a complaint through my NHS Trust %26amp; produced all the evidence which was damning. The GMC are also investigating. No one is in doubt that this happened due to the evidence I have retained..


I asked to be referred to an alternative specialist who says he won't see me without a chaperone. PLEASE NOTE MY COMPLAINT HAS NOTHING TO DO WIITH SEXUAL HARASSMENT! I was told it's the right of the new specialist to request a chaperone so I said '; fine, I'll look elsewhere as I've done nothing wrong and am being penalised simply because I submitted a valid complaint';.


I went to see my GP today and understand from her, that this last specialist wrote to her advising that they too should have chaperones.YOU REALLY MUST APPRECIATE THAT THE NHS [patients advice liasion service ] %26amp; GMC ARE ON MY SIDE %26amp; KNOW I HAVE NOT LIED. The specialist is within his or her rights to ask that you be accompanied. The 'chaperone' need do or say nothing. It protects both you and the specialist. It can be a relation, a friend or just a passing nurss.


There is no penal element and given that the GMC have made no findings or rulings on your complaint (the precise details of which would not be known to the new specialist) I can see a lot of sense in the suggestion.


You can complain to the Trust (about the request for a chaperone) but as you have no valid complaint it will not result in a satisfactory outcome for you.

I've just read your additional posts. There is no refusal of treatment. You are complteley wasting your time looking for solictors to represent you.


If they tell you you have a case, they're talking out of their bottoms; if they have any specialist experience, they'll tell you what I'm telling you.

read my answer more carefully asker - I have not said you do not have a vaild complaint, i said the GMC have not ruled on your complaint - they have made no final findings (according to you).


You see, the problem with much of Yahoo Answers is when you go on and ask a question and want actual informed advice, you get a host of uninformed opinion (much of it well-intentioned) and when one Reply gives you that actual answer, the 'thumbs down' mob are out in force becasue they don't like the reply.


If you want tea and sympathy, go and ask your mates down the cafe or pub. If you want the answer (which will save you much wasted time and heartache) read my reply above.

This is called closing ranks. You can't win. Have you ever heard of many NHS workers being fired?





The complaints system is a total illusion. It's there for aesthetics's.





Don't give up. They'll try to work on you until you do.
You don't actually say who ';He'; is???





Plus your new specialist has every right to request a chaperone - as much right as you have to bring one with you...





Don't see it as an insult - your new specialist is probably worried he may say or do somthing that may be taken out of context and doesn't want to be left without a job !!!





Reading your posts - you say you have now been left without treatment??? Did the NHS say ';we won't treat you'; - it seems you have NEVER been REFUSED treatment.





You are the one who said ';fine, I'll look elsewhere as I've done nothing wrong and am being penalised simply because I submitted a valid complaint';.





In black and white you aren't getting treatment becasue you refused the alternative.





To be honest if I was a specialist and your notes fell on my desk I would do exactly the same and request a chaperone to cover my back - yes you are honest and you aren't making it up but there are people out there who do this sort of thing for a living and get people struck off because of petty personal issues.





if your complaint is against a Doctor harrasing you - call the police ! Have you thought of doing that yet?





Ultimatly he would be investigated by the NHS/GMC but if you are being harrased and the NHS sack him what is stopping him to continue harrasing you when he's been sacked?





You need to go to the police - at the end of the day you are being harrased by an individual -doesn't matter whether its a doctor.





If you haven't been to the police yet and are just trying to sort this out via his employer it sounds to me like you don't want them to get into too much trouble (my opinion - please dont flame it !)

If was being harrased by a bin man (for example) I wouldnt go to the council I would go to the police !!!

you really do need specialist advice, have you been to the Citizens Advice Bureau?


that would be my best suggestion, unless someone can come up with something better.
Its such a closed organisation, they look after their own, look how long it took them to report Shipman.
As you have already tried PALS etc, the Ombudsman would be the next step. Contact your CAB again and ask them for the leaflet, 'Are you unhappy with your doctor, dentist, hospital or clinic?' They should have it. If not it is avaialble in PDF form. See website address below.
If this was a nurse they would be suspended and out on their ear. It never ceases to amaze me how much doctors get away with. It seems that the NHS has one rule for one and one for another. I know from personal experience but can't go into it ironically for legal reasons. All I will say is that it cost me my career and reputation so it works on both sides of the fence.
